FAQ

For the Stage 3 Medicaid EHR Incentive Program objective for EPs Provide Patient Access (measure 1), patient health information must be made available to the patient within 48 hours of its availability to the provider for an EP.  Does this include weekends?

We finalized in the 2015 EHR Incentive Programs final rule for Stage 3  that any patient health information must be made available to the patient within 48 hours of its availability to the provider (for an EP). We recognize that the change in the definition of timely access from within 4 business days to within 48 hours may negatively impact to provider’s workflows and ability of the provider to speak to the patient prior to making the information available to patients.  In addition, the EP may not be available during the weekend to perform the necessary review prior to posting.  Therefore, we clarify that the definition of timely access for Stage 3 can be interpreted as “within 2 business days.”
